Info : Reason i said put your hands up was cause there was an active shoot out as you can hear and if he wasn't involved like he said he was he was failure to value his own character's life. Otherwise if he didn't go back I would cuff him , put him to a safe location where there are no shots being fired. And why I think he's using a third party is cause 5 seconds later after he spots me more of his friends come out the balcony.
