Blacklist Length: 2 Days
Blacklist Reason: Batoning two officers on different occasions.
Unblacklist Reason: Both of these incidents were brought to the forums by me and both parties received punishment while I received verbal warnings for my role in the situation (Batoning an officer). I had originally received a warning point regarding a situation where I had batoned an officer as SWAT for shooting a medic and discharging their firearm. I appealed it and was let off with a verbal warning. The warning point appeal was accepted and closed. The officer that was involved received a three-day PD blacklist and got their role as mentor removed.

Another situation where I had batoned a Chief for batoning a detective was reported in the PR section by both me and involved Chief HuskyDog. This situation was looked at by both Alpha and the Police Supervisor. Alpha double-checked with the Police Supervisor to see if anyone deserved punishment and the results were, and I quote," After further review with a police supervisor, we have come to the conclusion that there was not significant misuse of power from either side. As such, the PR will be concluded in line with the previous comment.". The PR was locked and moved. Neither player received punishment which seemed fair enough.

Today around 6:02 P.M MST staff members HockeyExpert and Thanewolf decided that I should receive a two-day PD blacklist regarding the incident with the first officer as I only got away with a verbal warning while the reported officer lost their role as a mentor and received a three-day PD blacklist. HockeyExpert said that if I hadn't made the WP appeal and kept my WP then I wouldn't have received a blacklist but because I got my WP removed and got away with a verbal warning then they felt that they were being too lenient as the other officer got a much greater punishment while I practically got no punishment. So they decided the punishment would be a 2-day PD blacklist.

The reason why I feel this is unfair is that why should I receive punishment for something that was already dealt with and accepted/locked. Why tell me my WP appeal was accepted just to turn around and give me a PD blacklist for the same thing you accepted my WP appeal for? Especially when the reasoning for the blacklist is because server directors felt that because a player received a 3-day PD blacklist and got their mentor role removed that I should be punished alongside them in order for it to be fair as they took a greater punishment than me. If they had received a verbal warning then I can assure you I wouldn't have been punished this badly. But because one side had a greater punishment they thought it would be fair if I received a harsher punishment in order to not seem one-sided. I am not looking to upset anyone involved in this situation, I know the server directors didn't do this out of spite nor as intentional punishment. But I still feel as if this blacklist is unfair. I am requesting that I either receive a SWAT 2-day blacklist as both situations involved me as SWAT or altogether drop the PD blacklist.

After this situation was brought to my attention by @HockeyExpert30, he asked that I review the punishment and the video evidence that was provided. After extensive review, I was able to determine that you violated a number of Police / SWAT Rules, therefore I requested that HockeyExpert issue a blacklist.

Notwithstanding, the appeal for the warning point, I decided that a verbal warning was not sufficient for such an egregious display of abuse for a number of reasons listed below.

[5.2.1] General Law Enforcement Rules

Law Enforcement may not harm any other government officials - like the Mayor - but if roleplayed well they can work with others to bring them down.


As you were Law Enforcement at the time, and the target of your baton abuse was a fellow Officer, I am considering this a violation of rule 5.2.1 (1). For said violation, it was my opinion that you were no longer acting in Roleplay and instead misusing Police powers, in this particular case, such display was not enough to warrant a blacklist, but a verbal warning would be appropriate.

[5.2.2] SWAT Rules

1. A SWAT officer can not perform simplistic police activities like traffic stops or issuing traffic tickets, but can be called as backup if approved by the Mayor, Sheriff, Chief or Assistant Chief. They may only patrol during either emergency state or exceptionally risky conditions within the city.

You were not called for backup by the Mayor, Sheriff, Chief, or Asst. Chief to patrol the city, therefore your presence there as a "SWAT Sniper" was not within RP / Server Rule guidelines. The simple act of using your baton on an individual within that area, would be "simplistic police activities", and therefore should not be allowed.

2. As a SWAT officer, you are not above the Sheriff, Chief, Assistant Chief or Lieutenants. You might have better equipment, but you have no commands over the Police Department and Sheriff's Department.

When you decided to baton your fellow Officer, you were taking matters into your own hands, the correct course of action in this scenario would be to call attention of the player to Staff, seeing as this is no longer within the normal conventions of Roleplay. If anything, the second thing that should have been done was bring this to the attention of
a higher ranking Officer and have this Officer in question fired, reprimanded, arrested, etc, if you were going to Roleplay this scenario out. You are not above the Sheriff, Asst. Chief or Lieutenants and in this particular case, you would not just start hitting a fellow Officer with a Baton. If you truly felt like this scenario warranted action on your end in the confines of Roleplay, an Officer posing a threat to the public with discharging of a firearm would have been drawn on with rifles and fellow Officers would take them into custody.

3. As a SWAT officer, you may not be on "standby" for a prolonged period of time at the police station if there is no imminent situation or context warranting SWAT. Active and coordinated training in the SWAT team can always be a valid reason for SWAT to be deployed, unless the Sheriff requests SWAT to flag down.

You were situated at the hospital with your Bearcat, without the requirements for your presence being met. There was no emergency state, there were no extenuating circumstances requiring your attention or skills as a SWAT Member.


However, I do believe that I should have specified to HockeyExpert that the blacklist should have been for SWAT and not the Police Category, which was my mistake. This was brought to my attention rather late at night right after work, hence the ambiguity surrounding the situation. Hopefully, this has cleared up the confusion and my verdict will be as follows: You shall receive a SWAT Category blacklist for the duration of two days (factoring in your time served, one day starting at the time of the aforementioned PD blacklist.), along with the verbal warning for abusing baton on a fellow Officer. I will NOT reverse the decision to accept your warning point appeal considering good faith in my Senior Administrator, as well as the confusion on the blacklist reason and category. As such, I am considering this appeal, partially accepted.
