Hey RX55, from this point of view you can clearly see that I was on the opposite side of the vehicle, meaning that I had cover and enough time to draw my weapon. From this position I felt like I was in fear for my life so I drew my weapon knowing the man was on the other side of the vehicle. I also have a video, which shows this even more clear. This situation also took place at 4:45 PM EST.
After the situation had taken place, the player that I had killed PMed me saying he had a video of whatever he had seen. That's when I saved the last 2 minutes of my gameplay(which is what I have shadowplay set to), so the video starts off when I first get out of the car.
During this interaction, Danny also broke character by screaming: "You're breaking RP bud"

Aren't you supposed to destroy the items? Not take them? The whole time I was getting arrested after you never once destroyed either of the items. Not to mention you also gave me 1 year of jail time, which is far under the recommended sentence for "Attempted murder'

After having you in custody for about 10 minutes I decided I’d give you a 1-year sentence. Also, keep in mind it’s a “recommended” sentence. Also picking up a chunk of coal and deliberately and repeatedly dropping it on an unconscious person is attempted murder so there’s no need for the quotes.
And no, there's nothing in the rules stating you need to destroy evidence if anything that's the opposite of what you're supposed to do.

After reviewing the video, it feels like I am missing something.

The videos show a second party attempting to put the player being reported under FearRP. The issue is the distance between both players. He is asking the player to step out of the vehicle with his hands up, but per the FearRP guidelines for a player in a vehicle, the person would have to be standing directly by the player, preferably the driver-side window, in order to properly place this player under FearRP. The videos do not indicate this happening, and what resulted was the cop exiting the vehicle and retaliating in fear of his life.

The second issue is that the person witnessed in the video broke the rules by breaking character. At no time should you ever mention any OOC elements in-character, this includes calling for a staff member or saying that the player you're in a roleplay situation is in violation of the rules. What should have happened is the RP situation should have played out, and once it concluded, then a report could be made(or in the middle of the situation if possible).

Again, it feels like I am missing something. Cause the video shows the player exited the vehicle by the time he was given the orders, and was a distance away from the player. Not every situation is cut-and-clear, and this is an example of one of those cases. I'd love to hear more, especially since you tagged @mclovin as you are reporting a Mentor, and I'd like to give a proper verdict with all the evidence.

10-15 minutes after this situation I went to bed. I wasn't intervened by any staff member and I was wondering why he was tagged aswell.

Hello folks I honestly don't know why i was tagged other than i did handle the sit looked at the evidence and told them to make the player report as the player was not on.

This is gonna be denied.

The video(s) I watched don't show a clear and direct infringement on the FearRP rule. The person being reported was at a longer distance from the player, and on his side, was being given orders to exit when he had already stepped out of the vehicle. He was crouched, away from gunfire at the time, and I could see how an officer would pull their firearm out at this point. It'd have been different if he was directly next to the officers driver-side window, where FearRP would have to be followed. The issue here, witnessed in the videos, is distance.

I don't see any malicious intents by the player being reported, and I don't see any reason why I should punish this individual as I cannot see a clear violation of FearRP. The only thing I truly do witness is the player who had the gun breaking character, which is not allowed. If you witness someone breaking the rules, just report it, it's not that hard to not say anything about it in-game or in-character.
